9th Circuit Says Oregon County Can’t Collect $2.3M Defect Award

Congrats to Jeff Williams and the rest of the Wargo French Singer team for their Ninth Circuit win!

The Ninth Circuit affirmed a judgment by the District Court that Wargo French Singer client First Mercury Insurance Company did not have to cover a $2.3 million judgment obtained by the County of Multnomah for damage to the Morrison Bridge, a major thoroughfare into downtown Portland, OR.  The Ninth Circuit found, affirming the District Court’s grant of summary judgment, that First Mercury could not be liable because its named insured was found not liable, under Oregon’s Anti-Indemnity Statute.  This is an issue of first impression and Wargo French Singer is very pleased for its client’s success.
